CAREYES® PRIVACY NOTICE.

 

The privacy notice is a physical or electronic document, or in any other format, through which the person in charge informs the User about the treatment to which their personal data will be subjected. The privacy notice is based on the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, the "Law").

 

The purpose of the privacy notice is to establish and delimit the scope, terms, and conditions of the processing of personal data, so that the User can make informed decisions regarding their personal data and maintain control and disposition of the information that corresponds to them.

 

Likewise, the privacy notice allows the person in charge to make transparent the treatment or use it gives to the personal data that are in its possession, as well as the mechanisms that it has enabled for Users to exercise their rights in relation to their personal information.

If you consider that your right to the protection of your personal data has been injured by any conduct or omission on the part of CAREYES® or presumes any violation of the provisions of the Law, its Regulations, and other applicable regulations, you may file your disagreement or complaint with the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI). COMPREHENSIVE PRIVACY NOTICE FOR THE HANDLING OF PERSONAL DATA OF CUSTOMERS AND PROSPECTS TO CAREYES® CUSTOMERS.

 

1. IDENTITY AND ADDRESS OF THE PERSON IN CHARGE. In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Individuals (hereinafter, the "Law") and its Regulations (hereinafter, the "Regulations") we inform you that CAREYES®, with address at Carretera Melaque a Puerto Vallarta, kilometer 53.5, La Huerta, Jalisco, Mexico, C.P. 48894, is the owner and responsible and will process the Personal Data that you as a User of these provide us in terms of this Privacy Notice (hereinafter, the "Notice").

 

2. PERSONAL DATA WE COLLECT. The Personal Data collected will be treated and safeguarded based on the principles established in the Law and its Regulations, which are: legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility. To fulfill the purposes mentioned in this Notice, we require you to provide us with: (i) Identification Data, (ii) Contact Data, (iii) Financial Data, hereinafter referred to as "Personal Data"). It is important to mention that the aforementioned items are categories of personal data; in case you need to know each of the Personal Data that is collected, please contact the privacy officer of CAREYES® through the email support@careyes.com

 

2.1. SENSITIVE PERSONAL DATA. CAREYES® does not collect sensitive Personal Data from Users.

 

The information you provide must be truthful and complete. Therefore, the veracity of the data provided is under your responsibility and in no case will CAREYES® be responsible for this aspect.

 

3. PRIMARY PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA. CAREYES® as responsible, collects your Personal Data, in order to use them to carry out the following purposes: (i) Answer questions and comments about the contracting of any of the products offered by CAREYES®, (ii) Identify the person who requests any of the products offered by CAREYES® , (iii) Carry out the registration and registration of prospects to customers who requested any products offered by CAREYES®, (iv) Generate files for the follow-up of the prospects to customers and; (v) Compliance with applicable laws, regulations and legal provisions.

 

3.1. SECONDARY OR ACCESSORY PURPOSES. CAREYES® does not use your Personal Data for secondary or accessory purposes.

 

CAREYES® as responsible for the processing of your personal information, guarantees its proper use, protection, and confidentiality, so all the administrative, technological, technical, and physical security measures necessary to comply with internal policies and regulatory provisions have been established for the management of this. CAREYES® will keep your Personal Data for as long as necessary to carry out the purposes set forth in the Notice.

 

4. MECHANISMS FOR THE USER TO EXPRESS THEIR REFUSAL FOR SECONDARY OR ACCESSORY PURPOSES. By not processing Personal Data for secondary or accessory purposes, CAREYES® does not have mechanisms for you to express your refusal for these purposes.

 

5. TRANSFERS OF PERSONAL DATA. Transfers are communications of Personal Data made to people other than CAREYES®; in this sense, we inform you that CAREYES® transfers your Personal Data only in the following cases:

 

5.1. TRANSFERS THAT DO NOT REQUIRE YOUR AUTHORIZATION: (i) To subsidiaries or affiliates under the common control of CAREYES® or to any company of the same group that operates under the same internal processes and policies, to carry out the purposes provided in the Notice; (ii) In the event of a merger or division, to CAREYES® that acquires the legal obligations when carrying out the union or separation of CAREYES®, to carry out the purposes provided for in the Notice; (iii) To the internal and external auditors to carry out the activities inherent in reviews and evaluations of the information of CAREYES®; and (iv) To the competent authority, in case it legally requests your Personal Data.

 

The personal data that are collected by CAREYES® may be transferred to national or foreign third parties, such third parties may be affiliated companies or subsidiaries of CAREYES®; external professional advisors or other service providers acting as managers in the name and on behalf of CAREYES® , among them, logistics companies, in order to carry out the transport and delivery of goods, who will be subject to those established in this Privacy Notice.

 

6. MECHANISM OF ACCEPTANCE OF TRANSFERS. All the transfers previously referred to are necessary to comply with the legal relationship you acquire with CAREYES®, in this sense, it is not necessary for you to give your consent to carry them out.

 

7. MEANS AND PROCEDURE TO EXERCISE THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION TO REVOKE YOUR CONSENT (ARCO). You have the right to: (i) Access your Personal Data in our possession and know the details of the treatment thereof, (ii) Rectify them in case of being outdated, inaccurate or incomplete, (iii) Cancel them when you consider that they are not required for any of the purposes indicated in the Notice, are being used for non-consensual purposes or the contractual or service relationship has ended,  or (iv) Oppose the processing of the same for specific purposes, as provided by law (hereinafter, "ARCO Rights") or revoke your consent if it was previously granted. The Privacy Officer will be appointed at the proper time to conduct an appointment with the Privacy Officer.

 

Days and hours of operation are Monday through Friday from 9:00am to 5:00pm and Saturday from 9:00am to 1:00pm.

 

8. OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA. CAREYES® informs you that your Personal Data will be protected under strict administrative, technical, and physical security measures which have been implemented, in terms of the Regulation, in order to protect and guarantee your Personal Data against damage, loss, alteration, destruction or unauthorized use, access or treatment.

 

You may register in the Public Registry of Users (REUS) in accordance with the Law on Protection and Defense of the User of Financial Services to limit the use and disclosure of your Personal Data in Mexico This registration (REUS) allows the User to register in a database in order to restrict promotional calls in particular numbers (fixed or mobile), work or email, seeking to keep their privacy safe and avoid the inconvenience caused by these calls or sending information. 9. USE OF COOKIES, WEB BEACONS, OR OTHER SIMILAR TECHNOLOGIES. The CAREYES® Internet Website, www.careyes.com (hereinafter referred to as the "Site") uses cookies; cookies are data files that are stored on your hard drive when browsing the Site and that allow the exchange of information on the status of the Site and the User's browser. If you would like to know the procedure for disabling cookies, please refer to the help section of your Internet browser. Through cookies, CAREYES® measures information about Users who view the Site. Therefore, CAREYES® collects geographic information from the moment Users enter the Site, as well as the operating system, browser and medium (search or advertisement) with which they enter the Site. Similarly, CAREYES® collects the average browsing time and statistics of the most visited pages of Users. CAREYES® obtains the data in order to know the behavior of Users who are impacted through digital channels external to the Site or who enter directly.

 

10. PROCEDURE AND MECHANISM TO KNOW CHANGES IN THE PRIVACY NOTICE. Any changes or updates to the Notice may be consulted on the Site, in the section "Terms and Conditions", "Privacy Notice". The Privacy Notice may be modified at any time by CAREYES®, so its continuous review is recommended.
